CUSTOMER AGREEMENT AND TERMS AND CONDITIONS
INCIDENT ASSISTANCE AND CUSTOMER SERVICE INTERRUPTION SERVICES
This Customer Agreement and Terms of Conditions (“Agreement”) is entered into by and between you, the Customer, and Sychar, Inc., an Illinois corporation (“Sychar,” “we,” “us,” or “our”).
Please review the following Customer Agreement and Terms and Conditions carefully. Your acceptance below results in a legally binding contract. Any notices to Sychar should be sent to customer services at solutions@sychar.co.
SUMMARY OF SERVICES: Subject to the terms and conditions herein, Sychar provides incident assistance and customer service interruption reimbursement for parking lot damage and/or customer service failures.
DISCLAIMER: The following is not insurance. The Services offered here consist of service reimbursement and/or other services provided under applicable circumstances in accordance with the terms and conditions of this Agreement.
Definitions: For purposes of this Agreement:
"Service Reimbursement Payment” means a monetary payment from Sychar to Customer to reimburse for the estimated cost of Vehicle Damage, as determined by Sychar and/or its authorized agents, not exceeding $1,000 or $1500, whichever coverage is chosen at checkout.
**“Vehicle Damage”** means dents, scrapes, exterior impact points from other vehicles, brushing marks, ribbing, or scraping.
“Parking Facility” means the parking lot and/or garage where Customer’s vehicle is parked in connection with this Agreement during the Parking Term.
“Parking Term” means the day or days in which Customer’s vehicle is parked in the Parking Spot and for which Customer has provided payment to Sychar for one or more Services under this Agreement.
“Claims Communication Assistance” means assistance with initial contact and beginning the process of facilitating an insurance claim with Customer’s insurance carrier if the estimated reimbursement of vehicle damage exceeds $1,000 or $1500, as determined by Sychar.
“Qualifying Service Interruption” means a stoppage or hindrance of customer parking activity for more than 15 minutes. This includes failure to provide a reserved parking spot or a service attached to the parking agreement, like shuttle service. This does not include interruptions caused by non-parking lot staff or equipment, third-party contractors, internet or software issues, acts of God, weather, pandemics, riots, etc., or personal vehicle malfunctions.
“Parking Spot” means the specific parking spot assigned to Customer by virtue of Customer’s contract with the Parking Facility and in which Customer’s vehicle is legally and correctly parked during the Parking Term. If no specific spot is assigned, it means the spot Customer has paid for and where the vehicle is legally parked.
“Parking Event” means the parking services that Customer has contracted for with the Parking Facility during the Parking Term.
SERVICES
The Services provided under this Agreement are the following, subject to the Definitions above and all terms and conditions contained herein:
Description of Services:
- Incident Assistance Package
- Sychar will provide a Service Reimbursement Payment up to $1,000 or $1500 for Vehicle Damage to Customer’s vehicle while parked at the Parking Facility during the Parking Term.
- Sychar will provide Claims Communication Assistance for a claim filed with Customer’s automotive insurance carrier within 24 hours after the Parking Term ends.
- Incident Assistance and Customer Service Interruption Package
- Sychar will provide the benefits of the Incident Assistance Package.
- Sychar will provide a Service Reimbursement Payment up to $1,000 or $1,500 for a Qualifying Service Interruption occurring during the Parking Term.
Requirements to Receive Services:
Incident Assistance Package:
- Arriving at Parking Spot: Take and upload clear photos of the entire exterior of the vehicle upon parking to www.sychar.co.
- Leaving Parking Spot: Take and upload clear photos of the entire exterior of the vehicle upon exiting the parking spot to www.sychar.co. Failure to do so may reduce the likelihood of an approved Service Reimbursement Payment.
- Vehicle Damage must have occurred while parked.
- Submit any request for a Service Reimbursement Payment or Claims Communication Assistance to solutions@sychar.co within 24 hours after the Parking Term ends.
- Any negative reviews related to the Parking Facility or Sychar must be deleted before eligibility for any benefit under the Incident Assistance Package.
- The vehicle must remain in the Parking Spot, and Customer must retain possession of all keys during the Parking Term.
- A police report should be filed to assist in determining whether a Service Reimbursement Payment is approved.
Customer Service Interruption Package:
- Submit written documentation of any wait times due to a Qualifying Service Interruption to solutions@sychar.com within 24 hours after the Parking Term ends.
- If alternate services were required due to a Qualifying Service Interruption, submit documentation of payment for such services to solutions@sychar.com within 24 hours after the Parking Term ends.
- The vehicle must remain in the Parking Spot, and Customer must retain possession of all keys during the Parking Term.
EXCLUSIONS:
The following are excluded from the Services provided under this Agreement:
- Damage while the vehicle is moving in or out of the Parking Lot or Facility.
- Damage due to acts of God.
- Personal injury or harm to Customer or others.
- Damage to the interior of the vehicle.
- All other forms of damage not included in the definition of Vehicle Damage.
- Lost or damaged interior contents of the vehicle.
- Booting of Customer’s vehicle.
- Vehicle services such as jumps or tire changes.
- Parking tickets.
- Additional parking fees due to delayed flights or other delays.
- Legal fees.
REIMBURSEMENT PAYMENT PROCEDURES: If a Service Reimbursement Payment is approved, it will be paid within 7 days of approval. Approval is final only after all required submissions are processed by Sychar.
CANCELLATION AND REFUNDS: Sychar will honor the cancellation and refund policies of the Parking Lot where the vehicle is parked in connection with this Agreement.
NO LIABILITY OR BAILMENT: Sychar acts as a service provider offering additional Services. Sychar has no responsibility or liability in connection with Customer’s contract for parking with the Parking Facility except for the Services provided under this Agreement. No bailment is created by this Agreement, and no property interest is conveyed.
PRIVACY INFORMATION: By using this website, signing this Agreement, contacting Sychar through this website, or making submissions, Customer agrees to the terms of Sychar’s Privacy Policy, incorporated into this Agreement. The Privacy Policy can be accessed at www.sychar.co.
ADDITIONAL WEBSITE TERMS OF USE: By using this website, signing this Agreement, contacting Sychar through this website, or making submissions, Customer agrees to the Terms of Use, as updated from time to time at www.sychar.co.
GOVERNING LAW AND VENUE: This Agreement is governed by the laws of Illinois. Any action arising from this Agreement will be brought in state or federal court in Illinois. The Parties agree to the exclusive jurisdiction and venue of such courts and waive any right to a trial by jury to the extent permitted by law.
